The Service involves the storage of Data about a company or individual. That Data can include personal information. “Personal information” is information about an identifiable individual, and may include information such as the individual’s name, email address, telephone number, bank account details, taxation details, and accounting and financial information.

Currently our servers are located in Australia, primarily by Global Switch Pty Ltd. (Global Switch), and Your personal information will be routed through, and stored on, those servers as part of the Service. Global Switch complies with relevant aspects of the U.S.-EU Safe Harbor Framework and has certified that it adheres to relevant Safe Harbor Privacy Principles. If the location of our servers change in the future, we will update this Policy. You should review our Policy regularly to keep informed of any updates.
By providing Your personal information to CreditorWatch, You consent to CreditorWatch storing Your personal information on servers hosted in Australia. While Your personal information will be stored on servers located in the Australia, it will remain within CreditorWatch’s effective control at all times. The server host’s role is limited to providing a hosting and storage service to CreditorWatch, and we’ve taken steps to ensure that our server hosts do not have access to, and use the necessary level of protection for, Your personal information.
CreditorWatch is committed to protecting the security of Your personal information and we take all reasonable precautions to protect it from unauthorised access, modification or disclosure. Your personal information is stored on secure servers that have SSL Certificates issued by leading certificate authorities Symantec Corporation, and all Data transferred between You and the Service is encrypted.
However, the Internet is not in itself a secure environment and we cannot give an absolute assurance that Your information will be secure at all times. Transmission of personal information over the Internet is at Your own risk and You should only enter, or instruct the entering of, personal information to the Service within a secure environment.
We will advise You at the first reasonable opportunity upon discovering or being advised of a security breach where Your personal information is lost, stolen, accessed, used, disclosed, copied, modified, or disposed of by any unauthorised persons or in any unauthorised manner.
CreditorWatch will only disclose the personal information You have provided to us to entities outside the CreditorWatch group of companies if it is necessary and appropriate to facilitate the purpose for which Your personal information was collected pursuant to this Policy, including the provision of the Service.
CreditorWatch will not otherwise disclose Your personal information to a third party unless You have provided Your express consent. However, You should be aware that CreditorWatch may be required to disclose Your personal information without Your consent in order to comply with any court orders, subpoenas, or other legal process or investigation including by tax authorities, if such disclosure is required by law. Where possible and appropriate, we will notify You if we are required by law to disclose Your personal information.
The third parties who host our servers do not control, and are not permitted to access or use Your personal information except for the limited purpose of storing the information. This means that, for the purposes of Australian privacy legislation and Australian users of the Service, CreditorWatch does not currently “disclose” personal information to third parties located overseas.
If you choose to pay for the Service by credit card, Your credit card details are not stored by the Service and cannot be accessed by CreditorWatch staff. Your credit card details are encrypted and securely stored by Data Vault provided by Commonwealth Bank Of Australia to enable CreditorWatch to automatically bill your credit card on a recurring basis. You should review Data Vault by Commonwealth Bank of Australia to ensure you are happy with it.
It is Your responsibility to ensure that the personal information You provide to us is accurate, complete and up-to-date. You may request access to the information we hold about You, or request that we update or correct any personal information we hold about You, by setting out Your request in writing and sending it to us at firstname.lastname@example.org
CreditorWatch will process Your request as soon as reasonably practicable, provided we are not otherwise prevented from doing so on legal grounds. If we are unable to meet Your request, we will let you know why. For example, it may be necessary for us to deny Your request if it would have an unreasonable impact on the privacy or affairs of other individuals, or if it is not reasonable and practicable for us to process Your request in the manner You have requested. In some circumstances, it may be necessary for us to seek to arrange access to Your personal information through a mutually agreed intermediary (for example, the Subscriber).

We and some of our affiliates and third-party service providers may use a combination of “persistent cookies” (cookies that remain on Your hard drive for an extended period of time) and “session ID cookies” (cookies that expire when You close Your browser) on the Website to, for example, track overall site usage, and track and report on Your use and interaction with ad impressions and ad services.

At Coles, we respect the privacy of your personal information in our care. Personal information means information which identifies you as an individual or from which your identity can be reasonably ascertained.
Types of personal information collected
The types of personal information we collect includes name, contact details, identification information, household details, payment and transaction details/history (including information about payment cards linked to flybuys and associated transactions), details regarding participation in flybuys and our other clubs and programs operated from time to time, records of your communications and interactions with us, and details/history of preferences, interests and behaviour relating to transactions, products, services and activity with our digital services.
We may not be able to provide our products or services, or make offers to you without your personal information. For example, we may not be able to ensure you are awarded flybuys points, contact you or deliver your orders.
How personal information is collected and held
We may collect your personal information in relation to your interactions and transactions with us and Wesfarmers group companies. This includes: using your flybuys card or number or associated identifiers such as payment cards; making a purchase in store; placing an order online; making a non-cash payment; participating in a promotion, competition, or survey; registering for services; using related digital services. We may monitor and record your communications with us (including email and telephone) for security, dispute resolution, and training purposes, and we also operate video and audio surveillance devices in our premises. We may also collect personal information from third parties including public sources, information service providers, providers who administer Coles-branded products and services such as payment cards and insurance, anyone authorised to act on your behalf, and other Wesfarmers group companies including flybuys.
We hold personal information electronically and in hard copy form, both at our own premises and with the assistance of our service providers. We implement a range of measures to protect the security of that personal information. We also take measures in respect of destroying or de-identifying personal information that is no longer needed for any lawful purpose.
Purposes for handling personal information
We handle your personal information in connection with providing, administering, improving and personalising our products and services. This can include processing payments, delivering orders, managing promotions, providing refunds and discounts, verifying your identity, communicating with you (including direct marketing), conducting product and market research, maintaining and updating our records, dealing with enquiries from you, and working with our service providers and other Wesfarmers group companies. We and Wesfarmers group companies may exchange your personal information with service providers engaged to assist with services including data processing, data analysis, information broking, credit reporting, online computing, printing, contact management, legal, accounting, business consulting, marketing, research, auditing, archival, delivery, security, investigation and mailing services, and in the provision of Coles-branded products and services such as payment cards and insurance.
The third parties to whom we disclose personal information may be located in Australia and other countries including Argentina, China, Canada, Hungary, India, Israel, Ireland, Italy, Japan, Hong Kong, Mexico, Netherlands, New Zealand, Pakistan, Philippines, Poland, Singapore, Spain, South Africa, South Korea, UAE, United Kingdom and United States of America. We take steps to ensure that our service providers are obliged to protect the privacy and security of your personal information and use it only for the purpose for which it is disclosed.
We provide information and services through a range of digital and online services including websites (e.g. coles.com.au) apps, email, online advertisements, IPTV and social media profiles. These services may be operated by us, other Wesfarmers group companies and flybuys program participants (collectively, Coles/flybuys Digital Services) to provide a consistent experience, personalise your use of each of those services and provide targeted marketing.
Our systems record a variety of information in relation to interactions with our online services. This can include information about software versions used, device identifiers (like IP address), location data (where available and not disabled by the user), dates, times, file metadata, referring website, data entered and user activity such as links clicked.
Some information we collect in relation to Coles/flybuys Digital Services is not related to an individual. In many cases the information only relates to a device or is of an aggregated or statistical nature, and we will have no way of knowing the identity of the user. In other cases we may associate information about your use of Coles/flybuys Digital Services over time with your personal information, e.g. where on any occasion you have logged in, followed a link sent to you by email or we have otherwise been able to identify you.
Our online services may contain links to other sites. We are not responsible for the privacy practices or policies of those sites and recommend that you review their privacy policies.
Procedures for access, correction and feedback
If you wish to access or correct any personal information we hold about you or have any feedback or concerns about privacy, please contact us as set out below. Where you seek a response from us, we will let you know who will be handling your matter and when you can expect a full response.

Terms & Conditions of Coles Online Customer Credit Accounts
Coles Supermarkets Australia Pty Ltd ABN 45 004 189 708 trading as Coles Online (Coles Online) agrees to permit the Account Holder (you) to purchase goods on credit (Credit Facility) subject of the following Terms and Conditions.
If you or any person authorised by you (Authorised Operator) use the Credit Facility this means you agree to be bound by these Terms and Conditions. If you or any Authorised Operator use the Credit Facility after these Terms and Conditions are varied this means you agree to be bound by the varied Terms and Conditions.
To use the Credit Facility to purchase goods;
(a) you must have an ABN;
(b) each use of the Credit Facility must be for a minimum total purchase of $50;
(c) the Credit Facility must be used for transactions amounting to not less than $1,000 per month; and
(d) the Credit Facility must not be used to place orders requiring delivery on a Monday.
Failure to comply with these conditions may lead to cancellation or suspension of the Credit Facility, in the discretion of Coles Online.
The Coles Customer Agreement, a copy of which is located at https://shop.coles.com.au/a/a-national/content/customer-agreement - THEAGREEMENT , is incorporated into these Terms and Conditions and shall apply in respect of all sales made to you.
USE OF THE CREDIT FACILITY
The Credit Facility must only be used by You to purchase reasonable quantities of goods for use by your business and Coles may in its absolute discretion:
(a) limit the quantity of individual goods that may be purchased in a single transaction or multiple transactions on this Credit Facility; and
(b) terminate the Credit Facility where Coles considers that You are using the Credit Facility to purchase unreasonable quantities of goods.
Coles Online will notify you of your credit limit before a debt is first incurred.
Coles Online periodically reviews its credit limits. By using the Credit Facility you permit Coles Online to review and revise your credit limit from time to time.
Coles Online may increase your credit limit at your specific request. Coles Online may also increase your credit limit by notifying you of an increase. If you did not request an increase, you have 13 days to reject the increase from the date of the notice of the increase.
Coles Online may reduce your credit limit at your specific request. Coles Online may also reduce your credit limit without approval but Coles Online will not reduce your limit below the outstanding balance of the Credit Facility.
Payment of statement balances and/or invoices are to be made by direct deposit to Coles Online’s bank account the details of which will be advised when your account is approved.
Unless otherwise agreed, Coles Online will email you a monthly statement on the 1st business day of every month.
If you have negotiated a payment term other than monthly, statements will be provided more frequently as agreed between you and Coles Online.
You agree to make payment via the method specified above. You agree to deposit the funds with sufficient time for the payment to reach the Coles Online bank account by the payment date specified on the statement.
APPLICATION OF PAYMENTS
Coles Online will ordinarily apply payments against the oldest outstanding amount due.
If you or an Authorised Operator:
(a) obtain any credit by fraud or dishonesty;
(b) fail to pay any amount owed to Coles Online by the due date;
(c) breach any of these Terms and Conditions;
(d) use the Credit Facility in circumstances where Coles Online believes that the continued use of the Credit Facility may cause loss or damage to you or to Coles Online,
(e) any person who has guaranteed your obligations under the Credit Facility withdraws that guarantee, then Coles Online may close or suspend the Credit Facility. If the Credit Facility is closed or suspended, Coles Online may require you to immediately pay all outstanding amounts. Suspension or cancellation does not affect any of your obligations or those of any Authorised Operator, in respect of the Credit Facility.
USE OF INFORMATION
You acknowledge that Coles Online may use the information in the Credit Facility application:
(a) to send you information and promotional material. If you do not wish to receive direct marketing offers from Coles Online, call the Coles Online Customer Care Centre on 1800 455 400; and
(b) to verify your creditworthiness with third party agencies.
The law of the State of Victoria is the governing law of these Terms and Conditions and you agree to submit to the exclusive jurisdiction of the courts of Victoria.
You acknowledge that these Terms and Conditions on which the Credit Facility is issued may be changed at anytime by Coles Online or any of its related businesses by way of public advertisement or circular forwarded to you (including by email), and you will be bound by such Terms and Conditions unless you advise Coles Online that you do not accept them within 14 days of such notice being issued.
